Using an outbound auto dialer (ATDS) for calls and text messages?

A new FCC ruling for TCPA compliance will go into effect January 27, 2025, for companies using an auto dialer (ATDS) to make outbound marketing calls and text messages. This new ruling includes a requirement when buying marketing leads, the requirement for consent is changing from “one-to-many” to “one-to-one” consent on all marketing leads. Most marketing leads being purchased today from a lead supplier are “one-to-many”, which puts you at risk if you continue to use your current auto dialer. This all only applies if you are using what is classified as an ATDS, which most outbound dialing systems are.

5 months from now, when making outbound marketing calls using an auto dialer, one-to-one consent is required for all leads, OLD and NEW.
