Role Out of Florida Mini-TCPA Lawsuits Continues

The Florida Telephone Solicitation Act (mini-TCPA) has increasingly been generating lawsuits since it was enforced in June of 2021. The latest example of these lawsuits alleges that Herban Delivery, a cannabis delivery service, used an Automatic Telephone Dialing System (ATDS) to blast marketing texts. This suit has more standing in Florida due to the broad definition of ATDS in Florida’s Telephone Solicitation Act.
