A New TCPA World to Navigate

Think about this for a minute... “Imagine an industry that was just completely upended by a regulator’s ruling. Yet most players in that industry don’t have their own lawyers and only receive information word of mouth through conferences and their own individual research. Pretty unusual, I know. Yet that is literally the case with the lead generation industry. A bunch of small business types who get together a few times annually to gather information and education at conferences.” Eric Troutman recently wrote in one of his recent blog posts. That is an intense reality.

This means anyone who sells leads or buys them for their marketing efforts is going to be affected. The new rules will be enforced likely by Feb. 2025. That only gives you about 12 months to learn them and make changes.

A few key changes to note:

·         DNC protections extended to text messages. This means you can no longer send marketing text messages to individuals without their explicit consent.

·         Prior express written consent is now more narrowly defined. Consent must be obtained from the consumer for a specific seller, not just a lead seller. One-to-one consent.

·         Calls must be directly related to the interaction that prompted the consent. This means you can't use consent for one purpose to make calls for an unrelated product or service.
